Never mind that campaign-law violation: Suffolk clerk's office let suspected killer free by mistake

Channel 4 reports a clerical error by Maura Hennigan's Sufolk County Criminal Clerk's office meant a man scheduled for arraignment for an East Boston beating murder was able to walk out of custody and disappear.

This doesn't surprise me a bit! Seems like Suffolk county has more than one member at that court house who has lost their mind!! On friday a judge allowed a previously convicted muderer (who's case was overturned by the SJC due to (WHAT) another error (technicality) in that building) who is out on bail on a GPS monitoring device awaiting trial for MURDER off his bracelet!!!Why?? you may ask....well apparently it gets in his way at work as a mason!! WHAT?? since when does your choice of a job matter when it's a priviledge to be out of jail on bail and not an entitlement...This judge needs to be removed from the bench!!!

There have been numerous judges who have done some questionable things. Who do you complain to and not fear retaliation of some sort? I feel as though the majority of people hearing complaints a judge will think, "Yeah right".

Let's create a scenario where you are innocent of a crime they claim you committed. Now, let's assume that an error is made by the prosecution (they mixed up DNA samples in the lab) that results in your conviction. Should a judge overturn your verdict and free you even though you are now a previously convicted murderer? Is the fact that you are a "previously convicted murderer" something that should be held against your character for the rest of your life even if you are free to go?

It's not a privilege to be out on bail unless you fail to observe the principle of "innocent until proven guilty". I believe GPS monitoring is something that the defendant has to agree to in order to be imposed on him and it is entirely at the discretion of the judge. Unlike GPS monitoring of probation where you have been proven guilty and must be tracked as a condition of your early release from your punishment, monitoring at bail should be less onerous. If he is not guilty of the murder the state claims him to be, then why should he as an innocent man be forced to be tracked? Would you want to be tracked...you know, just in case you are guilty of a crime they think you committed?

Looks like nobody cares that a murderer was accidentally released. I think you should add that he drove a car, not a bike, away from scene. Then you'll get 50+ comments

The story is much more complicated.

A longtime well respected employee responsible for checking paperwork made a human error that was not caught by the person responsible (at the time) for checking her work one Bob DelloRusso. Coincidentally Bob is running against Hennigan and was Chief of Staff to former Speaker Sal DiMasi.

The first employee made a mistake because she missed the fact that the hyphenathed name of the individual was hyphenated in the wrong place so it got through the system. DelloRusso charged with signing off on the first employee's work either placed his faith in the longtime clerk and signed off on the release or he didn't care enough to double check the name on his own in the first place. So while a very human error was made it was in fact caused by the negligence of Hennigan's opponent not a result of any error on Hennigan's part
