Man killed in East Boston gunfight was constable, bounty hunter

UPDATE: Police say Figueroa was not licensed to carry a gun in Massachusetts. And Army says he didn't serve in the Army Reserves.

Kirk Figueroa, the East Boston man police say opened fire on officers responding to a domestic-violence call at his home, listed his occupation as founder of a private-security firm specializing in going after bad guys with heavy armament and dogs and protecting people with enough money to worry about needing protection.

Figueroa died and two officers were critically injured in what police say was a gun battle that started when Figueroa opened fire. Police say Figueroa used an assault-style rifle and was wearing body armor.

Figueroa called his company, which has an office near the Moakley Courthouse and a "Cobra Strike Team" in San Francisco, Elite Policing. The Herald reports police towed away a Crown Victoria with an "Elitepolicing.org" decal from 136 Gladstone St.

He also operated under the name Code Blue Protection Corp. In his trademark application for that name, filed in May, 2015, he described his services as:

Security services, namely, armed escorts and security personnel for celebrities, diplomats, events, in-mates, prisoners, parolees, others.

Figueroa's Web site claims eight years as an MP with the US Army Reserve, adds:

A California Bounty Hunter and mixed martial arts practitioner, Kirk has established a fast turnaround time when meeting the demands of returning clients. He was licensed to be a constable and a bail bondsman, so both the city,state, and feds thought he was above some of the laws commoner "civilians" must follow.

You think all those private armed security guards around corporate VIPs and celebrities have to follow the same rules as John and Jane Q. Public? Hell no, the entourage of the wealthy, beautiful and important get privileges you see. And the politicians and law enforcement officials getting a nice wad of cash to hand out licenses or look the other way are ok with it as long as nothing bad winds up in the press like this.

These type of goons have been roughing up people at hotels and nightclubs in the city for decades.

Heaven forbid you get served a summons or skip bail and get swatted by one of these turkeys.

Constables are law enforcement with arrest powers authorized by BPD and the city council. The Globe had an article on corruption and abuse in the constable credentialing process in Boston recently. It's all about who a candidate knows not their real qualifications.

Serving warrants for failure to appear in small claims court, etc. one can arrest people during daylight hours solely for their the purpose of bringing them before a magistrate. I guess that also applies to bail jumpers.

Lots of people have former police cars (Crown Vics) that come up on the used car market. You can also easily purchase a "police package" type from a dealership, meaning that it may not have certain things such as a radio or CD player.

Constables have very limited authority to serve papers or act to execute certain legal documents. They are just a few steps above civilian and well under that of police or sheriff. They usually need to serve under another constable for a period of time (now - not in the past) or take a specific classroom training course. They must also post a bond fee. Getting to be a constable is not that hard and all you need is a few signatures from certain people (see application on line) and then get voted upon by a local elective body. Once you post the bond fee and insurance fee you are good to go.

It seems this chap was under another impression as to what he could or could not do, and if he was operating in other states, those states may or may not have licensed him to do other things. From the sounds of it, this is a company that is hired muscle and possibly bounty hunters which only can operate legally in certain states. Many states prohibit bounty hunters.

If he was already wearing body armor as the news is reporting, he was already expecting trouble either from the police or elsewhere.

This may (and should) tighten up on the rules. I know a few people who are constables and renew the license regularly but hardly if ever use it. Only some are good at it and even fewer can make it as a full time living. Like being a taxi driver, this is a profession that requires you to hustle to make a buck.

There are people in this state who have second hand used Ford crown Victoria police surplus cars that they got from local or national auto auctions, the police package engine and I guess the cage that divides front and rear seats in car, spotlight outside drivers side door remains even the front bumper guard on car remains , the only things that come off the car are the strobe lights and siren, But there are websites where the car owner can order blue lights and have them secretly hidden behind front grill of car, and can easily , must I say illegally use the car on a highway and pull over people.

Especially with the police saying he didn't have a license to carry in Mass. Also odd: When you Google the corporate names, you get links to the sites and to the various aggregator sites that list businesses, but next to nothing from people talking about the companies. Still, he did spend money on trademarks and the like, so there's that.

I Hope the officers are recovering, East Boston will get back on its feet and continue on.
Thank goodness that innocent lives weren't taken..Thank goodness that every single cop from around the city and some from beyond assisted these two brave officers.
Usually if you been a long time Eastie resident and you hear multiple sirens it's always a fire truck last night was different you didn't hear fire trucks , what I heard was screaming sirens one after another you can also hear the engines from the v8 engines of the Ford Crown Vic's roaring up Bennington street, something major is happening and it ain't no Fire this time.

As I said in the initial post, I'm in Chelsea. I've been on sabbatical for months now so I'm usually home during the day.

I always knew when a live shot was being done because you'd hear the choppers were nearby.

Mr. Figueroa never attended basic training or advanced individual training. He did enlist in the U.S. Army Reserve in February 2003, but received a hardship discharge five months later,

This means he was in the Army Reserves, though he didn't go on active duty for training. As I remember it from my Army days, you can enlist with a unit and attend drills while waiting to go to basic training. It's also possible he never served with a unit and was only waiting in the IRR. It's hard to know without any further information.
