O'Reilly's brother is restricted in his political activity by the Hatch Act because he is an FBI agent.

The Hatch Act is to keep federal government employees from using their positions to favor a party or candidate. I don't know if O'Reilly's brother's actions constitute a violation. He was active in his brothers campaign but there is no indication he used his power as an FBI agent on behalf of the campaign. That said:

The main question in this race is what has Kerry done in the last three years and what issues is O'Reilly campaigning on.

The primary is September 16. This is when democrats choose their candidate. (The winner faces off against Republican challenger Jeff Beatty in the Nov. 4 election.)
