what's "commercial" about MassCops.com ?
That seems to me a very weak claim on GateHouse's part. If that claim fails, so does the entire legal threat, since GateHouse articles have a Creative Commons license.

Google adsense right on the main page. Any revenue made from the site makes it a commercial entity.
The suit is ridiculous though and endangers a number of other websites.

Masscops copies the entire article text and pastes it into their forums, instead of just linking to it like the rest of the world.
What they are doing is not covered by fair use doctrine, and it sounds like a pretty open-and-shut case to me.

Note the section in there about how it is largely irrelevant whether a site is 'commercial' or not.
It's funny to see how they've reacted. I can't help but think of all the stories we've seen on BPDnews (or non-LEO postings on Masscops)...the reaction is strikingly similar. "Don't they have something better to do" "tell them to go fuck themselves", "let's ignore it", etc.
