A federal appeals court yesterday dismissed a lawsuit by the sister of Juston Root, shot 31 times in 3 seconds by Boston and State Police officers along Rte. 9 in Brookline in 2020, ruling that the officers had more than enough reason to fear for their lives and the lives of nearby people, both because he had pulled what appeared to be a gun on officers outside Brigham and Women's Hospital and because when the officers approached they thought he was about to pull a gun on them. Suffolk County District Attorney Kevin Hayden said today no criminal charges are warranted for the police gunfire outside Brigham and Women's Hospital that injured a hospital valet and sent Juston Root driving down Rte. 9, until he was stopped and shot to death by pursuing officers near the Chestnut Hill Star Market on Feb. 7, 2020. Juston Root threatened several Brigham and Women's security guards with a realistic-looking replica gun before chasing after a Boston Police officer with it on the morning of Feb. 7, Suffolk County District Attorney Rachael Rollins said today. The officer, in fear for his life, opened fire on Root, as did another arriving officer. Read more.
Boston Police this afternoon released some preliminary information on the morning incident that ended with a Brigham and Women's Hospital valet wounded, the suspect dead, the hospital locked down and several cars damaged in a crash that shut the westbound side of Rte. 9 in Brookline. Read more.

A shooting on Fenwood Road outside a Brigham and Women's building shortly after 9 a.m. resulted in a chase that ended with a car crash outside the Star Market on Rte. 9 in Newton and a suspect taken away in critical condition. Read more.
