State Police put trooper apparently caught pepper-spraying protester on 'restricted duty'

State Police report:
On Tuesday, the State Police placed the trooper depicted in the video on restricted duty pending completion of a department investigation. The name of the trooper is not being released while the internal investigation is underway.
State Police add they have tried but have so far been unable to talk to Kin Moy, who was videoing a trooper as he and others tried to move protesters off the turnpike last Thursday when he was sprayed in the face.
The Herald reports Moy said he wanted to talk to the ACLU before he speaks to State Police internal-affairs investigators.

Pepper spray.....
Should not be used against passive resistant subjects like the person in this video. Therefore, excessive force was used in this situation, unless there are separate rules that I am unaware of for riotous situations. I doubt there are, and even if there were, this was an individual officer using your standard canister of pepper spray.
"Should" or "Shall"?...
Also, in my experience a passive resistor may be subject to the use of an irritant when they fail to comply with verbal commands, including the threat of the use of pepper spray.

He used force against someone
He used force against someone who was not committing a crime, who was engaged in a protected activity, and was not acting violently. Disagree all you want, but the Trooper assaulted that person. Should be disciplined.

There were many others in the roadway, why did the police only pepper spray this person. They don't pepper spray sports fans when they run into the streets after a win (though they did murder one young woman). If it was okay to pepper spray people who block roads, why did they single out this one person?

Kin Moy finally shows some wisdom by resisting the invitation of IAD to file a complaint. Perhaps he knows he was wrong? . After involving himself in or near the attempt to shut down a major interstate highway (I-93), then ignoring officer presence and verbal commands, a few blasts of pepper spray were the next logical step. The trooper used something less than body blows from the baton or collapsible asp but more than the verbal commands that were being ignored. Training took over. The trooper's only mistake, if any, was failing to place Moy into custody for his tumultuous actions. I would have had him in the wagon the minute he blocked the roadway and placed the motoring public at risk, without benefit of permit. Much more patience than me, trooper.

Police Soft and Hard Empty Hand Techniques?
Indeed Pete, soft and hard empty hand techniques come between refusal to obey verbal commands and pepper spray. Again, I would have started with soft hand techniques to arrest Moy but under the circumstances of rioters attempting to shut down an Interstate, and the risk of escalating by placing hands on one agitator, I have no problem with a few quick bursts of pepper spray to protect the lives and property of motorists on the Interstate and urban roadways who may have had no idea they were about to be placed at risk. As those of us who've been sprayed (in order to carry it) can testify, it's a non-lethal, temporary sensation, sort of what protesters have been looking for in other cases.

Substantiate this latest piece of crap, if you please. And then go pepper spray yourself in the eyes and enjoy the "temporary sensation".
"Premier State Police Agency??"
A while back the MSP Colonel stated the MSP was the "Premier State Police Agency." Since then their conduct, in a variety of situations, has been absolutely deplorable (on and off duty.) If anything they acted like a bunch of poorly trained clowns. This pepper spray incident is yet another example.
If Governor Baker wants to make cuts to the budget get rid of half of them and they would not be missed!!!!
From what I've read the tactic goes like:
The police corral everybody by surrounding them, and then start with the tricks; pepper spray, some clubbing, punching, pushing, what have you. They simultaneously are telling the crowd to move/disperse, although, since they're surrounded by the police, that is impossible. The rest, as they say, is predictable...
