Guy with drugs trying to evade arrest or man terrified of strangers following him in a black car?
A Dorchester man had bail set at $500 yesterday on charges related to drug possession and a car chase from Roslindale to Forest Hills that ended with him running over a cop's foot and crashing into a car on Washington Street.
A prosecutor and Joseph Jaquez's lawyer gave dramatically different accounts of how Jaquez wound up in custody Monday night at his arraignment yesterday in West Roxbury Municipal Court.
An assistant Suffolk County District Attorney said officers from the BPD drug-control unit noticed a Roslindale man known to them standing outside making several phone calls and sending text messages, when a black Nissan pulled up.
The man - also in court yesterday, also on drug charges - and Jaquez had a short interaction that the cops suspected might have been a drug transaction, the prosecutor said.
Officers drove off after the car, whose driver appeared to be taking "counter-surveillance" measures - he kept turning onto different streets in the area of Kittredge. Eventually, he wound up all the way up on Ukraine Way, just short of the Forest Hills T stop, where the plainclothes drug-control officers and a marked cruiser stopped him. One of the drug officers noticed an empty plastic bag on the front seat, opened the passengers-side door and asked Jaquez if he'd dropped or swallowed anything. Jaquez laught, said no, and then, the prosecutor said, put the car in gear, and with the passenger-side door still open, took off, running over the officer's foot and started a new chase, which ended soon after on Washington Street after he hit a car.
He was charged with possession of class A and B drugs and leaving the scene of a collision causing personal injury.
His lawyer, however, said Jaquez was only acting out of fear of strange men following him. He said Jaquez, who has no record save a single dismissed charge in 2013, was returning home from Legacy Place in Dedham when he noticed a black car following him. The turns in the warren of streets around Kittredge were not "counter-surveillance" but an attempt to see if that strange car was, in fact, following him and then an attempt to shake it. At Ukraine Way, when some guy in plain clothes opened his door and reached in, he wondered, "Who is this guy? And he took off," his lawyer said. He said the cop wasn't seriously injured - he was present during Jaquez's booking.
Jaquez's lawyer did not touch on his alleged interaction with the other man, Randy Darren Phillips. Judge Mary Anne Driscoll released Phillips, charged with possession of class A, B and C drugs, on personal recognizance - provided he immediately check into a Danvers detox facility where he'd already been scheduled to report yesterday.

Nice to see that you can run people over, especially cops, and the Massachusetts judges only assign a $500 bail on you. I wonder why cops always seem so angry.

You need to read up a little bit on bail in Massachusetts. I'll give you a preview. The first section is entitled "Bail is not a Form of Punishment."
How many skip out on bail?
The point of bail is to ensure someone returns. Honest question: How many figure they can stand to lose the bail money and skip town?
The other reason for bail
is if someone is likely to be a danger to society, based on the available information.

Then drive to a police station, stupid. Oh, wait, you're breaking the law. Funny how that works.
Drugs should be legal, but they aren't, so maybe try a little harder to not get caught with them.
And which police station would that be?
Not saying I'm taking his side, but, I don't know, if I were from Dorchester and driving home from Legacy Place (up Washington to what's left of the Arborway to Morton, I guess), I wouldn't have the slightest idea where the nearest police station was.

Purpose of bail
Yes, Mr. Ironside, I know what the purpose of bail is. His should have been much higher. If the man was so anxious to escape police that he is willing to run over one of the officers, I'd be concerned that he might not show up for court unless there is something valuable to ensure his promise that he will. But then again, as one of the distinguished elite pointed out earlier, it was only his foot.

The judged probably took the story at face value. If he attended every hearing in his previous case, that is proof that he will most likely turn up for his current case.
