BOSTON (WHDH) - A 71-year-old woman says she is lucky to be alive after a speeding vehicle struck her car, sending it into the front porch of a home in Hyde Park on Friday morning.

Rebecca Tenenholtz told 7NEWS that she was pulling out of her driveway around 10:30 a.m. when another vehicle hit her.

The impact of the crash sent Tenenholtz’s car into the front porch of a house on Dana Avenue.

Yes, the systemic issue of people driving like maniacs needs to be addressed. But without seeing the damage to the other vehicle, it's hard to be sure who is legally at fault. It's unclear whether she fully entered the roadway then was hit, or whether she backed into someone. I'm going to lean toward her being hit since the distance her car was, uh, flung suggests she was at rest or close to at rest and was contacted squarely by the front bumper of the other vehicle, but it's hard with just the one vehicle shown. (Former insurance claims person.)

I am no expert, so I have no clue who is or might be at fault. I'm just glad nobody was seriously hurt.

Maybe, but doesn't seem to show much damage. If that was the car, coming the same way it is facing - it would show some pretty apparent signs of the collision.

You're correct, there isn't a lot of damage to the car parked up on the sidewalk, but there is some damage. The front bumper is mostly detatched...sneeze, and it will fall off. It also looks like some of the body is torn away from around the right front wheel (of the car...it will be on our left in the video).

I don't know which car is at fault, but the one on the sidewalk does seem to have been involved, even if only peripherally.

How much above the speed limit does someone in the road have to go before they’re at fault for hitting someone pulling out of a driveway?

There can be some overlap and some skew between actual cause and legal fault.
The driver on the street could have been doing 50 in a 25 zone, but the legal fault and possibly ticket would be to the driver leaving her driveway for "failure to yield"

Would depend how far out she was and what parts of the vehicles collided. If she backed into the speeding driver, the speeder is a masshole, but people entering a roadway are legally required to make sure that no oncoming traffic is or will be an obstruction. Practically speaking, in the city, this often means that we are relying on other drivers to slow a bit and let us in, but we can't legally count on them to.

If the speeding driver hit her while she was fully in the roadway, then they failed to stop for an obstruction and are at fault.

isn't a proportional response. This menace was clearly speeding and inattentive otherwise this would never have happened. Plain and simple. Gosh, cell phone addicted speeders really are the frailest crowd.

Y'know, you've said in three separate comments that the person was cellphone-distracted - despite none of the news articles saying it, no witness saying it, and all authorities simply saying "remains under investigation".
There's a decent chance you're correct, but jumping to conclusions just helps to undermine any prospect of taking you seriously.

If I back out of my driveway and into the path of an oncoming car, I wouldn't be blaming the driver of the car for hitting my car. And yes, I have a driveway with worse sighlines than can be found on this stretch of Dana Ave.
