Condo association at pricey Back Bay building goes to court to make one owner stop screaming

The condo association at One Dalton - the Back Bay tower that also includes a Four Seasons Hotel - today sued the owner of a 35th-floor unit they say has disregarded repeated entreaties and even fines to stop screaming, playing loud music and partying at all hours of the night.

In a suit filed in Suffolk Superior Court, the Trustees of the Private Residences at One Dalton are seeking an preliminary injunction to order Jiacheng Sun to knock it off at least until they can make their case to a jury why they need a permanent no-screaming order.

The association, which represents the owners of the 61 condo units in the tower, said Sun has blithely continued to make "excessive noise which is destroying his adjoining neighbors' ability to peacefully reside in their own Units:"

More specifically, at late hours in the evening and early hours of the morning, the Defendant is shouting, having parties, have loud and audible conversations in Common elements and is generally a disturbance to his neighbors. Additionally, due to Defendant's disturbances and noise, adjoining neighbors are regularly unable to sleep at night.

In their complaint, the trustees say they asked Sun politely several times earlier this year to cease the screaming and music they say would start around 11 p.m. and sometimes last until 7 a.m.

When that didn't work, they followed up three times with fines - now totaling $6,000 - and then with letters from a law firm warning of possible legal action.

On Nov. 28, the law firm notified Sun that he was being fined for violating the no-screaming policy for two nights, both of which the firm says came after it had notified him on Nov. 21 to cease with the screaming, but that just as important, a lawsuit was imminent.

Sun paid $2.23 million for his 897-square-foot 1-bedroom unit in July, 2022, according to Suffolk County Registry of Deeds records.

He has until April 16 to file an answer to the main complaint.

I heard about some very expensive condo building in NYC that has all kinds of problems, bad soundproofing being the least of them. Apparently the building sways so badly that it has affected the functionality of the elevators. Rich people stuck in elevators for hours. It also leaks badly and the garbage chute is designed in such a way that when someone on the 35th floor puts something in it, it sounds like a mortar fire when it hits the bins. These are also $1 million+ condos.

I have a family with 3 kids under 10 above me in my high rise and they won’t put a rug over the floor - which is in condo agreement. FWIW I raised 2 kids in same building but we kept rugs till youngest was around 7.

When you buy you basically agree to these terms. If some9me 8s just not caring and ignoring fines, generally they can be kicked out or forced to sell. It is harder if they are all paid off.

he paid for his unit he can do whatever he likes. if you don't like it move.

He paid for his unit subject to certain conditions in an agreement he signed, including that he not be a nuisance to other residents. Assuming the complaint's assertions are correct (he hasn't had a chance to answer it yet), if he didn't like those conditions, he shouldn't have moved in.

Then his noise can stay in his unit. He has no right to extend the noise anywhere past his walls and doors.

What does this Association think was going to happen when you put a bunch of unrelated people in a living situation where you are living above, below and beside each other?

I dunno, has anybody ever tried it? Would it be an interesting experiment, to create multiple-dwelling building with unrelated people occupying different units?

And I bet he is, too. He probably bought into the building thinking it was all absentee investors with empty units. If you read some parts of the Internet, people are sure of this.

Yet apparently there are people here bothered by noise.

I remember in my teens when Bobcat Goldthwait began doing comedy...I said to myself, "how much caffeine/meth do you have to consume in order to to be that hyper?" The Bobcat Goldthwait these days is infinitely calmer.
