Man on probation for raping a drugged 14-year-old in Cambridge is charged with Downtown Crossing stabbing, police say

Calvin Spencer

A man was stabbed on Winter Place off Winter Street in Downtown Crossing around 8:15 a.m.

Transit Police officers found him, bleeding from wounds to his left arm and left side, just down Winter Street at Washington Street. Boston Police called in the homicide unit because of the severity of his injuries. Boston Police report the man was later upgraded to stable condition.

Police report arresting Calvin Spencer, 33, of Boston on a charge of assault and battery with a dangerous weapon, police say, adding he was initially arrested on outstanding warrants for larceny and failing to register as a sex offender.

Along with two other men, Spencer was charged with nine counts of rape of a child by force for a 2011 incident in which they liquored up and drugged a 14-year-old girl they had met in the Harvard Square Pit, then took turns raping her in a building near Central Square.

The men first got her drunk and stoned and then gave her a percocet pill. The girl was a McLean Hospital patient who had been given a day pass to go into Boston to arrange a Portuguese class but went to the since demolished Pit instead.

Spencer was held both in jail and at Bridgewater State Hospital for long periods of time until he pleaded guilty in March, 2022 - and was sentenced in Middlesex Superior Court to 8 to 12 years in prison. He was then promptly released because of all the time he had spent behind bars before his sentencing and placed on three years probation, court records show.

Just five months later, a Middlesex Superior Court judge sentenced him on a probation violation to another 1 1/2 years in prison, less 63 days for time he had spent behind bars before trial, court records show.

As Transit and Boston officers responded to Downtown Crossing, they began looking for a man matching Spencer's description, from the Red Line stop down towards Mass and Cass. Transit Police found the white cap with blue trim and its authenticity sticker a witness had spotted him with in a trash can at the Downtown Crossing station. They eventually found Spencer on the Forest Hills platform on the Orange Line at Downtown Crossing.

Innocent, etc.

That little police booth outside the DTX station has been a florist shop for several years now at least. And even that is rarely staffed.

If he got 11 and a half years in 2022 for a probation violation minus 63 days time served; Shouldn't he have still been in jail until 2033? Is it really possible to get probation for a probation violation? That makes no sense.

He wasn’t given traditional due processes for some reason (assuming mental health). He was arrested in 2011 but not sentenced until 11 years later.

They subtract time the person has already spent locked up while awaiting trial/sentencing. And this guy spent a lot of time locked up after his arrest, in part because of questions whether he was competent to stand trial - his docket is full of competency hearings.

it was 1.5 years, not 11.5. minus 2 months means he got out about 8 months ago.

Roaming around DTX. Many tourists. City Hall is a joke. City, state, federal governments are a joke. They refuse to acknowledge the real reasons for our crime, violence, homeless and substance abuse problems. DTX was an incredible place to visit, for locals and tourists alike, 1990s, early 2000s.
