I don't know what happened here, but there is a good chance either driver is at fault.

You can't avoid being to the right of a vehicle that is passing YOU on the left and then turns across your path!

In your world, of course, there is never more than one possibility. You have decided that such things never happen, so they therefore must never happen. Never mind substantial evidence to the contrary, Roadman has decided! He is a decider!

Then again, you are the guy who decided that a two year old who picks up a gun and shoots a sibling or a parent should be arrested and tried for murder. And decided that people shouldn't be allowed to join together to lobby for their interests or pass initiative petitions regarding their own governance.

Don't put yourself in that situation by passing the truck on the right. And if a truck starts to pass you, then back off so if they do start to turn, they won't strike you.

Oh, but Swirlly has decided long ago that truckers are Satan's representatives and pure evil. Despite the laws of physics and bilnd spots, and irresponsible actions by right-passing cyclists (IDIOTIC law that needs to be repealed), the driver is ALWAYS at fault (another IDIOTIC law that needs to be repealed). But I guess the concept that, when approaching an intersection, the traffic to the left of you might actually want to turn right, and that you should EXPECT that to happen, is foreign to you.

And what is your precious bike lobby always saying about "equal rights, equal responsibility?"

Let's do a story problem: A cyclist is going 10mph. A truck is going 30mph. The truck overtakes the cyclist and then turns right. Which vehicle caused the collision?

Roadman answer: BIKER PASSED THE TRUCK ON THE RIGHT AT A SLOWER SPEED! BY EVIL MAGIC!

So you have never been passed by someone on the left side going a higher rate of speed? Ever? Wow. That's truly amazing. You can't think outside your own self-declared boxes to save your life.

You have no control, car or bike, if a truck passes you on the left and then turns without notice. None. But understanding that might challenge your inability to consider different possibilities. So you default to foolishly insisting that a slower moving vehicle must have passed on the right.

This is why people like you (and Will LaT and my aspy relatives) don't make laws or run the world, no matter how much you think you have it all down to a dichotomous flow chart of black/white right/wrong. Because your oversimplifications do not adequately represent the world.

The one making the turn must yield to the one going straight ahead.
In this example the truck driver has the responsibility to be sure the lane to the right is clear before entering that lane.

Unless, of course, you want to leave the scene and pretend that you didn't know you killed someone - someone who simply must have magically passed you on the right at a much lower rate of speed.
