Man pulls out realistic-looking BB gun in argument with neighbor in Roslindale, police say
Boston Police report arresting a resident of Brown Avenue in Roslindale after he allegedly used what looked like a gun to threaten a resident of the intersecting Ridge Street in an argument around 10 a.m. on Sunday.
Officers set a perimeter around the home and requested assistance from the BPD SWAT Team. While awaiting the arrival of the assisting units, officers were able to convince the suspect to exit the building at which time they conducted a pat frisk with negative results. SWAT Team members then arrived on scene and performed a protective sweep to clear the residence, removing the remaining occupants. The officers were then granted permission to search the house which led to the recovery of a silver and black Umarex 4.5mm .177 caliber BB gun.
Christian Roman, 21, was charged with assault by means of a dangerous weapon, police say.

This is still assault
even if the weapon is legal to own and use.
Yep, assault is defined by whether somebody feels threatened
And a "dangerous" weapon doesn't have to be illegal.
Go into a store, put your hand in your pocket and motion at a clerk as if you're holding a gun as you demand he empty the cash register and you could be charged with armed robbery even if you didn't actually have a gun.
Same with assault with a dangerous weapon, although in this case, one could argue a BB gun is a "dangerous" weapon; it might not kill you, but as we all know, it could put your eye out. Shoes are perfectly legal in Massachusetts (well, I assume), and yet, if you punch somebody to the ground and start kicking them, you'll be charged with assault and battery with a dangerous weapon (shod foot).
